Terms and Conditions

All orders from Punky Cakes are subject to the following Terms and Conditions. 

Orders

• For all Custom Cakes (Wedding, Custom Carved, 3D, Gravity Defying, Celebration Cakes) please allow a minimum of 14 days' notice. At times we may be able to accept short notice cakes/orders but this is not common and your order may be subject to a rush fee. Please book with us as soon as possible as we limit how many orders we take on per week to ensure the highest of quality product. We are currently booking out 1-2 months in advance. Any inspiration images provided of other cakes, will only be reproduced by Punky Cakes as our interpretation of that cake and will not be a reproduction of picture/photo. Confirmation of Orders

• All order requests are processed through QuickBooks electronic invoice. Once your order request is submitted, if accepted you will receive a confirmation email. Please ensure all contact details, personal information, spelling of names, pickup dates, times and any requested changes have been properly documented on your form. Once everything has been confirmed we will email a quote based on the information provided. Quotes normally take between 2-3 business days after receiving but may take up to 5 days.

• Orders must be paid in full in order to be confirmed. No deposits are taken and no payments at pickup will be accepted.

Cancellations and Refunds

• Once an order is accepted and paid for, no refunds will be issued. All cancelations must be submitted in writing via email or certified letter by the client who placed the order and it is the responsibility of the client to ensure receipt of the cancellation. On receipt of the cancellation, the client will be sent a confirmation notice via email. Cancelations for orders that have been paid in full must be made before work has started on the order, this includes but not limited to florals, figures, custom décor pieces, custom designed boards, etc. A refund may be issued minus the 50% non-refundable retainer fee and cost of the items already worked on/ordered/in progress. For the cancelation of orders paid in full that have been mostly or fully completed, no refund shall be issued.

Changes

• Any changes made to your order within 10 days of collection or delivery may incur a surcharge, depending on the change requested. In most cases changes can be accommodated, however at times it is not possible. We will however endeavor to accommodate you to the best of our ability. Only the client on the invoice will be allowed to request changes.

Pick Up & Delivery

• Cakes and other products are made and packaged in a safe way so that they are stable when travelling. Clients wishing to pick up their orders are responsible for the safe delivery and transportation of their order and Punky Cakes does not accept responsibility for any accidents that occur once the order has been collected. Cakes/orders for pickup are to be collected from our premise at a prearranged time and date only. Failure to collect the cake/order at agreed upon date and time may result in forfeit of order and monies paid or a storage fee. When delivering, Punky Cakes is not responsible for any damage to the cake/order after setup is complete. Cakes/orders may be heavy and will require a sturdy table, and optimal room temperature of 75˚ degrees or below. Punky Cakes is not responsible for any damage to the cake/order, or shortage of the product, caused by a guest, caterer, wait staff member, or any other person not employed by Punky Cakes. Outdoor/Open Venue Delivery: Client understands that Punky Cakes is not responsible for the condition of products following set-up. Due to the effects of outdoor weather conditions, table on un-level ground, wind blowing undesirable atmospheric items (e.g., dirt, leaves, bugs, branches, etc.) sunlight, temperatures, humidity and other wildlife, it is understood that products such as icings, fillings, buttercreams, cake decorations, fondant, etc. may not hold up. Client agrees to make arrangements for a proper and secure environment for the cake/order. Client assumes full responsibility for the event guest and agrees to hold Punky Cakes harmless from and against all bodily injury, property damage or consequential damages. If the incorrect delivery address is supplied or if there is no-one to receive and no safe place (as unilaterally judged by Punky Cakes) to leave the ordered products, then the product will be returned to Punky Cakes premises and we will contact you to arrange pick-up / re-delivery upon availability. The client will thereby agree that this may result in additional charges for both the safekeeping and re delivery of the order. Failure to pay any fees incurred will result in forfeit of the order and monies paid. If the order is not collected within 24hrs the order and monies paid will be forfeit and no refund shall be given.

Design

• Any samples, drawings, or descriptions we issue, and any descriptions or illustrations contained on our website and social media are issued solely to provide you with an approximate idea of the cakes/orders they describe and remain the property of Punky Cakes. Punky Cakes aims to produce products of the highest standard that fulfil the desires of our clients as we understand them. It is important to remember that we are dealing with food and art and no two products are truly ever the same. There are times when we will need to make decisions during the process of creation that may affect the style of decoration, proportion or structure of the product. Color can be subjective and it is vital that clients wishing for exact color matches provide color samples and discuss the desired color when ordering their cake. With regard to ribbon, we will do our best to match samples provided but are limited by the options available. Client assumes full responsibility for making sure all non-edible cake décor, including but not limited to, sugar flowers, cake supports, dowels, internal supports, etc. are removed prior to serving. Sugar flowers and toppers are made from edible materials but are not intended for consumption as wires are added for strength and flexibility to achieve a more desired look. Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption. DO NOT EAT DECOR. . 

Bold Colors

• As bold and rich colors are becoming increasingly popular please note that Fondant, Buttercream, Ganache etc. that have been colored/painted (black, red, etc.) may stain clothing, tongue, teeth and other materials. It may also give off a bitter taste due to the amount of pigment needed to achieve the desired shade.

Consultations

• Virtual and face-to-face consultations are only available by request for weddings and usually held only once a month at a pre-arranged date and time. The duration of each consultation will average between 30-45 minutes. All consultations are charged a small fee to cover time and travel.

Serving Sizes

• Serving amounts provided by standard shape cakes are based on dessert sized portions being 1" wide x 2" long x 4"-5” high per slice, Punky Cakes warrants all cakes will provide at least the requested number of servings when properly cut according to this standard. Serving slices cut smaller or larger than the Punky Cakes recommended standard serving slice will affect the actual number of servings. If you would like to serve larger slices than the Punky Cakes standard slice, we recommend ordering a larger cake to accommodate the difference. Due to the custom shaping of specialty carved cakes the serving amounts are estimated and are not guaranteed to be exact.

Storage

• All cakes should be kept in a cool dry place out of direct sunlight and where it won't be bumped or knocked. We recommend all of our cakes be stored in the fridge, preferably in the box they were supplied in, unless otherwise noted by us. CAUTION: as it is possible for your cake to take on smells/odors from the fridge please remove all strong odor items such as seafood, garlic, onions, etc. Depending on size, remove your cake from the fridge at least 1-4 hrs. before serving so your cake can fully come to room temperature. All of our cakes, when cold, they will be firm and may seem “dry”. For best flavor and taste please allow the cake to fully come to room temp. Note: it is normal for cakes to sweat when coming from a cooler temp (fridge) to room temperature. Our products are made fresh containing no additional additives or preservatives and it is our right to assume that the consumption of the products will be on the day requested.

 

 

Allergens

• As cakes/orders are baked/prepped in a kitchen where allergens may be present, unfortunately, Punky Cakes is not allergy friendly and does not offer allergy free options at this time. All of our ingredients are of the highest quality. All products and equipment may come in contact with or contain traces of milk, eggs, fish, shellfish, tree nuts, nut oils, peanuts, wheat, and soybean or have been processed in a plant/facility containing one or more of the following allergens. Punky Cakes does not cater to allergies at this time.

Fresh Flowers

• If fresh flowers are provided by an outside source, they are required to be available at the venue on the day of the function prior to the cake/order being delivered unless otherwise stated by Punky Cakes. If flowers are not available at the time of delivery, Punky Cakes will not be responsible for prepping and arranging them on the cake/order. Fresh flowers will not be inserted into the cake/order without being suitably wired and taped. Please be advised that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Please consult with your florist of choice as lots of desirable flowers are toxic/poisonous and even with prepping are not suitable for placement on or near anything edible which may result in some/all flowers not being arranged on the cake/order. Punky Cakes cannot be held liable for any reactions caused, illness or death.

Photographs

• All cakes/orders are photographed prior to and upon delivery from multiple angles to show stability and quality of work. Punky Cakes reserves the right to use any photographs for display or promotion without compensation to you. Our designs may be published or shared in national wedding cake magazines, websites, and other publications. We reserve the right to use any image of a product made or rented from Punky Cakes for publications at a later date.

Disputes

• Complaints are very rare and due to the amount of work put into each individual cake/order; we take them very seriously. Any issues must be brought to our attention within 48hrs of collection or delivery to give fair opportunity to assess the nature of the complaint. Both parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issues between the parties amicably. Complaints regarding the decoration of celebration cakes can sometimes be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Any refund given for disputes regarding a cake/product design or production of a design are completely at the discretion of Punky Cakes and are not automatic. Full refunds will never be given for any cake/order which has been consumed regardless of dispute, as consumption of the product is viewed as your acceptance that the cake/order is adequate for the purpose for which it has been supplied. Where the complaint is in regard to the quality of the cake/order then the cake/order, or remainder of the cake/tier/order, must be returned to us as soon as possible after cutting and within 48 hrs. of collection/delivery to ensure that we are able to fairly assess the nature of the complaint. All products delivered to venues are photographed from different angles to show cake/order quality on delivery. We do not accept any responsibility for loss or damage to the cake/order items...such as knives, decorations, tablecloths, stands etc. once the cake/order has been delivered to a venue or collected from our shop. Please note for disputes we will only deal with the client who placed the original order.

Punky Cakes promises a product of high quality and service, but is not liable for any unforeseen circumstances, including but not limited to inclement weather, transportation problems, illness, accidents, labor disputes/strikes, Acts of God, and any other causes beyond reasonable control. A delay in transit shall not constitute grounds for a discount or refund. 

​By paying the invoice, the client accepts All Terms & Conditions. Quotes are valid for 7 days from date given but requested dates are not guaranteed until the invoice has been paid and cleared.
